These Terms of Service ("Terms") govern your access to and use of the Canna Data Science platform ("Platform," "Service," or "we"). By accessing or using our Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Platform, you confirm that you:

• Are at least 21 years of age
• Have the authority to enter into these Terms on behalf of your organization
• Will comply with all applicable laws and regulations
• Have read and understood our Privacy Policy

2. Description of Service

Canna Data Science provides a software-as-a-service (SaaS) platform for cannabis cultivation analytics, including:

• Cultivation tracking and batch management
• Financial analytics and cost-per-pound calculations
• Environmental monitoring data aggregation
• AI-powered data analysis and insights
• Reporting and compliance tools

Important: We are an analytics and intelligence platform. We do not control cultivation equipment, environmental systems, or compliance submissions. We integrate with your existing systems but do not replace them.

3. Account Registration

To use the Platform, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activity under your account

4. Free Trial and Subscription

Free Trial

We offer a 30-day free trial with full access to Professional plan features. No credit card is required to start the trial. At the end of the trial, you may choose to subscribe or your account will be downgraded.

Paid Subscriptions

• Subscription fees are billed in advance on a monthly or annual basis
• You may upgrade, downgrade, or cancel at any time
• Refunds are provided on a 30-day money-back guarantee basis
• Price changes will be communicated at least 30 days in advance

5. Your Data

Ownership

You retain all ownership rights to the data you upload to the Platform. We do not claim ownership of your cultivation data, financial records, or other proprietary information.

License to Us

You grant us a limited license to store, process, and display your data solely to provide the Platform services. This license terminates when you delete your data or close your account.

Data Export

You may export your data at any time in standard formats (CSV, Excel, JSON). We will provide reasonable assistance for data export upon account termination.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Upload malicious code, viruses, or harmful content
• Attempt to access other users' accounts or data
• Reverse engineer or copy Platform functionality
• Resell or redistribute Platform access without authorization
• Use the Platform to violate cannabis regulations

7. Intellectual Property

The Platform, including its design, features, code, and documentation, is owned by Canna Data Science and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without written permission.

8. Third-Party Integrations

The Platform may integrate with third-party services (Metrc, QuickBooks, environmental sensors, AI providers). Your use of these integrations is subject to their respective terms. We are not responsible for third-party service availability or functionality.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy or completeness of analytics and insights
• Uninterrupted or error-free operation
• Compliance with specific regulatory requirements

You are responsible for verifying any analytics, reports, or AI-generated insights before making business decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANNA DATA SCIENCE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the fees paid in the 12 months before the claim

11. Indemnification

You agree to indemnify and hold harmless Canna Data Science from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

Either party may terminate this agreement:

• You may cancel your subscription at any time through your account settings
• We may terminate your access for violation of these Terms
• Upon termination, your access ends and data is handled per our Privacy Policy

13. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Humboldt County, California.
